These Terms & Conditions ("Terms") govern access to and use of nyayakosh.com ("Platform", "Service", "we", "us", "our"), a document processing platform that provides OCR (Optical Character Recognition) and bookmarking services for legal and general documents.
By using the Service, you agree to these Terms. If you do not agree, do not use the Platform.
1. Nature of the Service (Legal Document Disclaimer)
nyayakosh.com is a technology platform, not a legal service.
We:
- Do not provide legal advice
- Do not verify legal authenticity
- Do not certify correctness of judgements or court documents
- Do not replace official court records
OCR and bookmarks are assistive tools only and must not be relied upon as definitive legal records.
2. Eligible Use (Legal Documents)
You may upload:
- Court judgements
- Orders, notices, pleadings
- Legal PDFs and scanned images
- Personal or organisational legal records
You must ensure that:
- You have legal authority to upload the document
- Uploading does not violate confidentiality, court orders, or professional obligations
- You are compliant with applicable laws and regulations
- You are at least 18 years of age
3. Ownership of Documents
You retain full ownership of all uploaded documents ("User Content").
nyayakosh.com does not claim ownership of your documents.
4. Licence to Process & Store
By uploading content, you grant us a limited, revocable, non-exclusive licence to:
- Store documents securely
- Run OCR and text extraction
- Generate bookmarks, metadata, and indexes
- Allow you to view, download, and manage documents
This licence exists only to operate the Service.
5. Storage, Retention & Access
- Documents are stored securely in our database
- Stored to allow future access and downloads
- Retention continues until you delete the document or your account
⚠️ We recommend users maintain local backups of critical legal documents.
6. OCR Accuracy & Legal Risk Disclaimer
You acknowledge that:
- OCR accuracy depends on scan quality and formatting
- OCR output may contain errors, omissions, or misinterpretations
- Bookmarks are auto-generated or user-defined and may be inaccurate
You must always verify OCR text against original documents before legal use.
We are not liable for legal consequences arising from OCR errors.
7. Confidential & Sensitive Legal Information
You acknowledge that uploaded documents may contain:
- Personal data
- Confidential legal information
- Sensitive case details
By uploading such documents, you explicitly consent to automated processing and storage.
We do not manually review documents, except:
- For support requests
- When legally required
8. Prohibited Use
You may not use the Service to:
- Upload documents you do not have rights to
- Violate court confidentiality or gag orders
- Distribute unlawful, defamatory, or restricted material
- Attempt system abuse, scraping, or exploitation
- Use automated bots or scripts without authorisation
- Circumvent security measures or access controls
Violation may result in account suspension or termination.
9. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted service
- Scheduled maintenance may cause temporary unavailability
- We are not liable for losses due to service downtime or interruptions
- We reserve the right to modify, suspend, or discontinue features with reasonable notice
10. Third-Party Services
The Platform integrates with third-party services including:
- Authentication: Google Sign-In, Supabase
- Cloud Infrastructure: For storage and processing
- Payment Processing: For paid features (if applicable)
Your use of these services is subject to their respective terms and privacy policies.
DATA PROTECTION & DPDP ACT COMPLIANCE
11. Data Controller & Processor
Under the Digital Personal Data Protection Act, 2023 (DPDP Act):
- You are the Data Fiduciary (controller of your uploaded content)
- nyayakosh.com acts as a Data Processor
We process data only on your instructions via platform usage.
12. Personal Data Processed
Depending on documents uploaded, we may process:
- Names, addresses, identifiers
- Case numbers, legal references
- Metadata extracted during OCR
- Account and usage data
13. Lawful Basis for Processing
We process data under:
- User consent
- Contractual necessity
- Legitimate interest in operating the Service
- Legal compliance, if required by law
14. Data Security Measures
We implement reasonable technical and organisational safeguards, including:
- Access control
- Secure storage
- Encrypted connections (HTTPS/TLS)
- Role-based permissions
However, no system is 100% secure.
15. Data Retention & Deletion
- Documents remain stored until deleted by the user
- Users may request deletion of their account and data
- Upon account deletion, data is removed within 30 days
- Certain metadata may be retained for legal or compliance reasons
16. Data Principal Rights
As a Data Principal under DPDP Act, you have the right to:
- Access your data
- Rectify inaccurate data
- Delete your data ("Right to Erasure")
- Withdraw consent at any time
- Export your data (where technically feasible)
- Lodge complaints with the Data Protection Board of India
Requests can be made via our Grievance Officer (see Privacy Policy).
17. Cross-Border Data Transfers
Your data may be stored or processed on servers located outside India. We ensure reasonable safeguards consistent with data protection laws.
18. Payments & Refunds
If you purchase paid features:
- Payments are processed securely via third-party providers
- Prices are displayed before purchase
- Refunds are handled on a case-by-case basis
- Pages purchased are non-transferable and may expire as per plan terms
Contact support for refund requests within 7 days of purchase.
19. Account Termination
We may suspend or terminate access if:
- Terms are violated
- Required by law
- Security or compliance risks arise
- Account remains inactive for extended periods
Upon termination, stored documents may be deleted after 30 days.
20. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for data loss, legal damages, or reliance on OCR output
- We are not liable for third-party service failures
- Total liability is limited to fees paid in the last 12 months (if any)
21. Indemnification
You agree to indemnify nyayakosh.com against claims arising from:
- Uploaded documents
- Legal misuse of OCR output
- Violation of laws or third-party rights
- Your breach of these Terms
22. Dispute Resolution
Before initiating legal proceedings, you agree to:
- Contact us to resolve disputes informally
- Allow 30 days for resolution attempts
23. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
Courts located in New Delhi, Delhi, India shall have exclusive jurisdiction.
24. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or platform notification. Continued use after changes constitutes acceptance.
25. Severability
If any provision of these Terms is found invalid, the remaining provisions continue in full force.
